Gateshead man found guilty of fly tipping

A Gateshead man has been prosecuted after he was caught fly tipping.

On 14 October 2024 a fly tip occurred in the rear alleyway, behind Fern Dene Road, Gateshead.

CCTV captured a hire van driven by Jack Harrison of Florence Avenue,Gateshead drive into the rear lane of Fern Dene Road and fly tip a mattress and bed before driving off.

Harrison was issued with notice under the provisions of S.108 (j) of the Environment Act 1995 requiring him to provide information relevant to the investigation to which he failed to attend.

Mr Harrison was summonsed to attend before South Tyneside Magistrates Court on 13 May 2025, and when he failed to attend a warrant was issued for his arrest.

On 19 March 2026 he was arrested by police and appeared at Newcastle Magistrates Court for the offence where he pleaded guilty.

He was found guilty of a Section 33 1(a) prohibition on unauthorised or harmful deposit, treatment, or disposal of waste (fly-tipping).

As a result, the magistrate ordered him to pay a £320 fine, £162 compensation and £326 costs (100 legal 226 enforcement).

The Council remains committed to keeping the borough clean and tackling fly tipping by ensuring guilty individuals are prosecuted.

Anneliese Hutchinson, Strategic Director for Economy, Innovation and Growth at Gateshead Council said:

"We will continue to tackle fly tipping by gathering evidence and pursuing offenders through to prosecution.

"This prosecution is a great example of how we worked in conjunction with the police to bring an offender to justice.

"Gateshead residents deserve to live in a clean and safe neighbourhood, and we are taking firm but fair action to improve the environment."

Residents are encouraged to report any incidents of fly-tipping. Illegal dumping is a criminal offence that can result in fines, legal action, and the seizure of vehicles involved. If someone is removing waste on your behalf make sure you know it's being disposed of properly.
