Mobile Elevated Working Platform (MEWP) licence terms and conditions

Gateshead Council will not be held responsible for any claims, legal actions, or damage that may happen because of this licence or permit. 

  1. No works can begin on the public highway without a valid and authorised licence in place. 
  2. Any changes to these terms and conditions must be approved by Gateshead Council before the licence is issued. Any approved changes will be stated on the licence.
  3. Requests to relax or amend the terms and conditions must be submitted at least five working days before the licence is needed. 
  4. Gateshead Council does not guarantee, nor imply, that any request to relax or change the terms and conditions will be approved. 
  5. The licensee must notify Gateshead Council of any requirements from statutory authorities that may result in a breach of the licence conditions and must comply with any changes to the licence as required by Gateshead Council. 
  6. Any required traffic management must be set up in accordance with Chapter 8 of the Traffic Signs Manual. 
  7. Temporary pedestrian walkways, at least 1200mm in width, must be provided and maintained at all times. 
  8. Users of the highway must be protected from falling debris, dust, and other pollutants in compliance with British Standards and applicable legislation. 
  9. The vehicle or plant must be properly signed, guarded, and illuminated in accordance with national regulations and any additional special conditions. 
  10. All necessary traffic signs must be erected before work begins and maintained at all times, in accordance with the regulations and any referenced publications. 
  11. Any vehicle or plant deemed a danger to the public, causing damage to the highway, or creating an obstruction beyond what is approved in the licence, must be removed immediately upon the instruction of an authorised officer of Gateshead Council, a police officer, or the written instruction of the highway authority. 
  12. If deemed necessary, a dilapidation survey will be conducted, and the licensee will be responsible for all reinstatement or repair work identified by the survey. 
  13. The licensee is responsible for repairing any damage to the highway caused by the vehicle or plant. If Gateshead Council needs to repair the highway due to damage caused by the vehicle or plant, they will recover the costs from the licensee. 
  14. The licensee shall indemnify the Council against any claims for injury, damage, or loss arising from the granting of this licence, except in cases where the injury, damage, or loss is caused by the Council's negligence or actions. 
  15. The licensee must provide a copy of the licence to the hire company (if applicable) for their records. 
  16. The licensee is responsible for ensuring that all statutory requirements are met. 
  17. A safe working area at ground level must be provided to prevent pedestrians from accessing the work area. A pedestrian walkway must be maintained around any temporary access arrangements or mobile lifting apparatus to allow individuals with wheelchairs, prams, and similar needs to pass safely. 
  18. If the apparatus is deemed to be in an unsafe condition or location, a highway officer will contact the licensee. The licensee must remove the apparatus immediately. If Gateshead Council arranges traffic management to prevent a dangerous situation, the costs incurred will be charged to the licensee. 
  19. Valid public liability insurance with a minimum cover of £5 million is required for the duration of the licence. 
  20. No advertisements, placards, bills, posters, or similar items shall be placed on or attached to the apparatus without the prior written consent of the Council.

  • I understand that the council has the right to revoke or suspend the licence and that no compensation will be payable
