CCTV Privacy Notice
Who we are and what we do
Gateshead Council have installed CCTV (closed circuit television) cameras in various locations across council premises for the purpose of:
reducing and detecting crime, disorder and antisocial behaviour in the area
This privacy notice provides specific information about how we process your personal data. It is an addition to the information contained in our Corporate privacy notice.
What type of information is collected about you
We collect personal information to understand your needs and provide services. Information may include:
- images, recordings or audio which may capture special category data (such as racial/ethnic origin, religion, health and sexual orientation)
- criminal offence data may also be captured
How we collect information about you
We collect information about you from the following sources:
CCTV cameras
through body cameras worn by enforcement staff
Why we need your information
Our purpose for collecting personal information is to:
- prevent and detect crime
- protection of public property and council staff
The lawful basis for our processing is
- legal obligation to which the data controller is subject (Health and Safety at Work Act, Anti-Social Behaviour, Crime and Policing Act)
- task in the public interest with a basis in law
- legitimate interests
Our lawful basis for processing of sensitive personal data is
- made public by the data subject
- legal claims or judicial acts
- reasons of substantial public interest (with a basis in law)
Who your information can be shared with
Our Corporate privacy notice explains information sharing the Council carries out. This sharing fulfils statutory obligations, legal requirements and service delivery. CCTV evidence may be shared with other agencies such as:
- the police
- fire brigade
- ambulance
- and other relevant agencies as required in the event of an emergency, prevention or detection of crime
Our lawful basis for this sharing is public interest and your consent is not required.
We may share your information with other council services such as the anti-social behaviour team or legal team without your consent where we have lawful basis for doing so. We may also share your information with third parties such as insurance providers or external legal advisers without your consent where we have a lawful basis for doing so.
How long we will keep your information
We keep your information for as long as we need to provide services to you. We may also need to keep your information in accordance with legal or other obligations. Where we have no need to keep your data it will be securely destroyed. We keep a Record of Processing Activity (a requirement under the GDPR). Where your information is held
Information is held in secure devices and secure servers located in council premises, Mobile CCTV (body worn cameras) have removable storage which is held securely in accordance with council policies and procedures when not in us.
