Anti-Social Behaviour Crime And Policing Act 2014
Public Space Protection Order 2026 (Shipcote)
I, Samantha Allcott, Strategic Director of Housing, Environment and Healthy Communities, on behalf of the Borough Council of Gateshead ("the Council") in exercise of the powers under sections 59 and 64 and 72 of the Anti-Social Behaviour, Crime and Policing Act 2014 ('the Act") and under all other enabling powers, being satisfied on reasonable grounds that doing so is necessary to prevent the detrimental effect referred to below from continuing, occurring, or recurring hereby makes the following Order as set out below:
1. The land described by the map attached and shown edged red ('the Restricted Area') being land in the area of the Council is land to which the Anti-Social Behaviour, Crime and Policing Act 2014 applies and will be protected by the making of this Order.
2. The Order may be cited as the Borough Council of Gateshead Public Space Protection Order (Shipcote) and shall come into operation on [X 2026] for the duration of three years.
3. The Council is satisfied that:
a. The activities set out at paragraph 4 below have had a detrimental effect on the quality of life of those living in the locality, and
b. The effect or likely effect of the activities
i. Is or is likely to be of a persistent and continuing nature,
ii. Is or is likely to be such as to make the activities unreasonable, and
iii. Justifies the restrictions imposed by this Order.
4. The activities are:
a. Drug dealing and drug use
b. Criminal activity including violence against the person, criminal damage, burglary and graffiti
c. Use of off-road bikes
d. Fly-tipping including large household items, general household waste and drug paraphernalia
e. Dog fouling
f. Abandoned vehicles
g. Arson
5. The effect of this Order is to impose the following conditions on the use of the land:
a. Restrictions on Access
Except as provided below, no person shall enter the Restricted Area at any time.
Alternative routes for vehicular and pedestrian access are via the highways to the front of each of the streets affected and which can be viewed in Schedule 1 to this Order.
Exemptions from Restriction
The restriction above shall not apply to:
i. Any occupier of premises adjoining or adjacent to the Highway or to any person engaged on Council business, police, ambulance or fire service personnel acting in pursuance of statutory powers or duties or to any statutory undertaker, gas, electricity, water or communications provider requiring access to their apparatus situated in the Highway.
ii. Any other person reasonably acting within the course of their duties.
Barriers
The Council may install, operate and maintain barriers ("Barriers") at the approximate locations marked on the attached map for the purpose of enforcing the restriction over the Restricted Area.
b. Prohibited Activities and Imposition of Requirements
Barriers and Obstructions
i. Any person accessing or egressing the Restricted Area via any Barriers shall ensure Barriers are closed and locked immediately after use.
ii. No person shall, without lawful authority or excuse obstruct Barriers, or the passage of any motor vehicle, motorcycle or pedestrian lawfully accessing or egressing the Restricted Area. For the purposes of this Order, an obstruction includes parking, causing or permitting any motor vehicle or motorcycle to be parked within the restricted area without lawful authority or excuse. Where a person (P) is obstructing the Restricted Area in breach of this prohibition, an authorised person may require P to remove forthwith the motor vehicle, motorcycle or any other thing causing the obstruction. An authorised person who imposes a requirement as set out above, must tell P that failing without reasonable excuse to comply with the requirement is an offence. A requirement imposed as set out above, by an authorised person who is not a constable or police community support officer is not valid if the person is asked by P to show evidence of his or her authorisation and fails to do so.
Waste Management and Fly Tipping
iii. No person shall leave or store the bin provided for use at their premises anywhere in the Restricted Area
iv. No person shall place their bin for collection anywhere other than outside of the Barrier on the correct day of collection and shall return it to the yard of their premises as soon as practicable on the day of collection after it has been emptied. Persons with an Assisted Bin Collection arrangement that is approved by the Council are exempt from this requirement.
v. No person shall deposit or leave any waste in the Restricted Area.
Dog Nuisance and Fouling
vi. Any person in charge of a dog which defecates in the Restricted Area shall remove the dog faeces from the land forthwith. Being unaware of the defecation or failing to have a suitable means of removing the faeces is not a reasonable excuse for failing to do so.
vii. Dog faeces must be disposed of by placing it in a receptacle which is provided for that purpose or in the household waste bin provided for use at your premises. Dog faeces must not be placed in any bin provided for use at other homes or businesses.
Prohibition on Anti-Social Behaviour
viii. No person shall behave in the Restricted Area in such a manner as to cause, or be likely to cause, nuisance or annoyance to any other person.
6. Failure to comply
It is an offence for a person without reasonable excuse to engage in an activity that is prohibited by this Order.
A person found to be in breach of this Order is liable on summary conviction to a fine not exceeding level 3 on the standard scale (maximum £1000) or to a Fixed Penalty Notice (maximum £100).
Fixed Penalty Notice
A police constable or police community support officer (PCSO) or an authorised officer of the Council may under Section 68 of the Anti-Social Behaviour Crime and Policing Act 2014, issue a Fixed Penalty Notice (maximum £100) to any person he or she has reason to believe has committed an offence, payment of which will discharge any liability to conviction for the offence.
Under section 66 of the Act, an interested person (as defined in that section) may apply to the High Court to question the validity of this Order on the grounds that the Council had no power to make it or that any requirement of the Act has not been complied with in relation to this Order. Such an application must be made within 6 weeks of the date this Order was made.
