Gateshead Exchange terms and conditions

Please read these terms and conditions carefully before using this site.

The Gateshead Exchange has been created to allow local voluntary organisations, social enterprises, schools, community groups and other organisations (the requestor) based within Gateshead to reap the wider benefits from contracts delivered in Gateshead. The concept is simple. Local voluntary organisations, social enterprises, schools and community groups (this list is not exhaustive) are encouraged to submit requests detailing what they need. Procurers and suppliers can easily view this list and align their social-value offers based on need. The Gateshead Exchange will help to maximise social-value benefits by delivering to the needs of the borough of Gateshead.

The council gives no guarantee that any Gateshead Exchange requests will be delivered. The council offers no guarantees or promises that any request made will be met in whole, in part, or at all. Neither does the council provide any promises or guarantees nor accept any responsibility in relation to the delivery or the quality of delivery of such requests. Any reliance placed on the delivery of a request made under the Gateshead Exchange is strictly at the requestor's own risk. The council holds no responsibility and cannot be held liable for the delivery or non-delivery of any request made.

Who we are and how to contact us

The Gateshead Exchange is operated by Gateshead Council.

By using the site you accept these terms of use and agree to comply with them.

We amend these terms from time to time. Every time you wish to use the site, please check these terms to ensure you understand the terms that apply at that time.

We may make changes to the site

We may update and change the site from time to time to reflect changes to our users' needs and our business priorities.

We may suspend or withdraw the site

The site is made available free of charge.

We do not guarantee that the site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

Please note that this does not extend to complaints about the quality of services or goods provided to you by any third party engaged through the site to which we shall be under no obligation to respond or forward. Any such complaints should be made directly to the third party concerned.

Our responsibility for loss or damage suffered by you

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, the site
  • the provision of or failure to provide goods, services or works by any third party engaged through the site or where such goods are defective or where the services or works are provided negligently, save where such services are provided by one of our partners. As such services are to be provided on a voluntary basis, it shall be your responsibility to ensure that all appropriate insurance policies are in place
  • use of or reliance on any content displayed on the site

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue
  • business interruption
  • loss of anticipated savings
  • loss of business opportunity, goodwill, or reputation

Please note that the purpose of the site is to facilitate transactions within Gateshead, but is not to be used by consumers to source goods or services. In using the site you confirm that you do not act as a consumer. You agree that we have no liability to you for any loss arising out of your use of the site where you act in breach of this provision.

Rules about linking to the site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to the site in any website that is not owned by you.

The site must not be framed on any other site, nor may you create a link to any part of the site other than the home page.

We reserve the right to withdraw linking permission without notice.

These terms of use, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England.
