A protester has failed in their bid to get the demolition of properties in Bensham halted.
The protester sought a judicial review of the Council’s action, together with a High Court injunction to have the demolition of Council-owned properties in Armstrong Street and Macadam Street halted. But in London earlier this week, the Honourable Mr. Justice Bean refused the protester’s application for an injunction to halt the demolition.
After due consideration, Gateshead Council has now decided to continue its demolition of Council-owned properties in Armstrong Street and Macadam Street.
The judge did impose an interim order on Gateshead Council to prevent it from demolishing nos. 46-49 Macadam Street – but these properties were not part of the demolition programme, they are not in the ownership of Gateshead Council and the Council had not intended to demolish them.
A High Court judge will consider the full application for a judicial review on 10 April.
