Gateshead Council’s Community Infrastructure Levy and Newcastle City Council’s Community Infrastructure Levy

Programme Officer

Brian Wilson has been appointed Programme Officer. He is the contact for any person who has made representations at the submission stage, and acts as a liaison between the examiner, the council and examination participants. He will act independently on behalf of the examiner to organise and manage the administrative and procedural matters of the examination process and is the first point of contact for any questions relating to timetabling or procedural matters.

All statements will need to be submitted through the programme officer and any matters that anyone wishes to raise with the examiner will also need to be submitted via the programme officer.

Examination news

22 August 2016

The Councils received the CIL Examiner’s final report on 17 August 2016 as enclosed as Document EX33 below. The CIL Examiner recommends that the Gateshead and Newcastle Charging Schedules be approved subject to modifications. Paper copies of the Examiner’s recommendations and reasons for those recommendations are available to view in compliance with CIL Regulation 23 and the section 212(8) Planning Act 2008 at:

  • Gateshead Council, Communities and Environment Reception, 2nd Floor, Civic Centre NE8 1HH (Monday to Friday, 9am to 5pm)
  • All public libraries in Gateshead
  • Newcastle City Council, Customer Service Centre, Barras Bridge, Newcastle upon Tyne, NE1 8QH (Monday to Friday, 8.30am to 4.30pm)
  • Newcastle City Library, Charles Avison Building, 33 New Bridge Street West, Newcastle upon Tyne, NE1 8AX (Monday to Thursday 8am to 8pm, Friday to Saturday 9.30am to 5.30pm and Sunday 11am to 5pm)

The issuing of the report means that the CIL examination is now closed. It is proposed to seek authority to approve the Gateshead and Newcastle Charging Schedules (incorporating the modifications) as follows for:

Gateshead – at the Gateshead Council’s Cabinet meeting on 1 November 2016 and then the Council meeting on 10 November 2016 and if approved, the levy charges will then become liable from developers from early 2017.

Newcastle upon Tyne – at the Newcastle City Council’s Cabinet meeting on 19 September 2016 and then the City Council meeting on 2 November 2016 and if approved, with the levy to take effect on Monday, 14 November 2016.

Since the hearing closed, the Court of Appeal has issued judgement on the case of Secretary of State for Communities and Local Government v West Berkshire District Council and Reading Borough Council (reference C1/2015/2559: [2016] EWCA Civ 441). I have written to the Councils to seek their views on any implications arising from this judgement and the reinstatement of the Written Ministerial Statement of 28 November 2014, for the setting of the charging rates. The Councils’ response is attached below. If you have any comments to make on this matter, including the Councils’ response, please forward these to the Programme Officer by Thursday 26 May 2016

EX24 Council Statement on the Implications of the Court of Appeal judgement

At the Hearings the CIL Examiner requested further evidence/information, as set out in document EX22 below, from the Councils and from other parties.

As agreed at the hearing session on the 22 April 2016, the Councils are now publishing for consultation a report which sets out this additional information. (see document EX23 below).

The consultation period will run from the 6 to the 20 May 2016, and all further submissions received during this period will be forwarded to the Examiner for consideration.

Gateshead Civic Centre Car Park

Please note that for the examination hearings being held on 21- 22 April 2016, there is limited public parking, in the green bays only, at Gateshead Civic Centre car park. A maximum stay of four hours and no return within four hours applies at a cost of 80p per hour. Those with disabled badges can park in the designated disabled parking spaces or in the public green bays free of charge if their badge is displayed. Details of the alternative car parks near the Gateshead Civic Centre can be viewed on our carparks webpage or you can contact the Programme Officer for assistance.

WIFI access at Gateshead Civic Centre

Anyone requiring wi fi access during the CIL Examination Hearings in Gateshead Civic Centre should submit a request to Brian Wilson, the Programme Officer, by email by Tuesday, 19 April 2016 at 5pm so that the necessary arrangements can be made as a password will be required.

On 8 February Gateshead Council and Newcastle City Council submitted their Community Infrastructure Levy (CIL) Draft Charging Schedules (DCS), and related evidence, to the Planning Inspectorate for an examination in public.
